Debt collectors in the UK are subject to specific regulations to protect consumers. They must demonstrate proof of the debt, cannot harass or intimidate, and must avoid contacting you at certain times or places. They also cannot claim powers they don't have or add unauthorised charges.
Key Regulations and Protections:
- Proof of Debt: Debt collectors must be able to prove the debt exists and that you owe it.
- No Harassment or Intimidation: They cannot use abusive or threatening language, cause a disturbance, or act in a way that intimidates you.
Limited Contact: Debt collectors can only contact you at certain times (generally between 8 a.m. and 9 p.m.). They cannot call excessively.
No Workplace Visits: Debt collectors are generally prohibited from contacting you at your workplace.
No False Claims of Authority: They cannot pretend to be bailiffs or enforcement agents, as this is a criminal offence.
No Unlawful Seizure of Assets: Debt collectors cannot seize assets without court approval.
No Adding Unauthorised Charges: They cannot add interest or charges unless they are part of the original agreement.
