As a fully approved financial conduct authority-regulated company that has won millions of pounds of compensation for our timeshare clients, we feel that we are responsible for highlighting the truth about timeshare claims.
Thousands of timeshare owners have indeed been refunded and compensated for mis-sold timeshares. However, it is not the case that timeshare claims are guaranteed or that paying upfront legal fees to present your case to the Spanish courts will lead to getting your money back.
Every month we receive hundreds of calls from past and present timeshare owners who have been told by marketing companies that they qualify for timeshare compensation when there would be more chance of getting the timeshare industry to apologise for the harm they have done to British consumers over the past 20 years! Never going to happen!
Here are some quick tips to ensure you're not wasting money on bogus timeshare claims.
Never pay upfront fees to marketing companies. Always get your information from the horse's mouth. The vast majority of timeshare claims companies that advertise on the Internet are just marketing companies run by ex-timeshare salespeople. Their job is to convince you that you have a valid claim, take your money from you, and then pass you over to another company to process your claim.
The key here is to always speak with the company dealing with your claim, not the messenger! One of the biggest complaints we receive is that consumers have paid a marketing company and then been told by the people dealing with their claim that they do not and will never qualify or receive anywhere near what they had been promised.
Being awarded a claim in principle through the Spanish courts differs from actually getting the money!
There is an untold amount of propaganda on the Internet that tries to justify paying upfront fees for Spanish timeshare claims. But unfortunately, very few claimants actually ever receive any money from Spanish timeshare claims, and those that do often get back less than what they have paid in upfront fees.
If you are going through the Spanish courts to make a claim, we would always recommend using a licensed Spanish solicitor that works on a no win no fee basis or who charges you the actual court fees once the case is ready for submission and then takes payment once you have received your money.
Most British solicitors stopped making Spanish timeshare claims some time ago due to winning the claim in principle but not actually receiving any money from the defendant.
